These Terms of Service ("Terms") govern your use of IsBridgeUp, operated by KarasSoft LLC, a Florida limited liability company ("we," "us," or "our"). The Service includes our website at isbridgeup.com, our web application at app.isbridgeup.com, and our mobile apps for iOS and Android. Our Community Guidelines are part of these Terms.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

IsBridgeUp is an informational tool that displays drawbridge status information based on public agency data feeds, vessel-tracking data, and reports submitted by users. The Service includes bridge status reporting, notifications, predictive features, a points-based reward system, live stream links (including a points-based stream slot auction), and local business advertising.

IsBridgeUp is not an official source of bridge operations and is not affiliated with, endorsed by, or operated on behalf of any bridge owner, bridge operator, transportation agency, or the U.S. Coast Guard.

2. Eligibility

You must be at least 13 years old to use the Service, and you must confirm that you are at least 13 before creating an account. By using the Service, you represent that you meet this age requirement. If you are under 18, you must have parental or guardian consent.

3. Account registration

To report bridge status, earn points, or participate in auctions, you must create an account using Sign in with Apple, Google, or Facebook. You are responsible for maintaining the security of your account. You agree to provide accurate information and to update it as needed.

You may not create multiple accounts, impersonate other users, or share your account credentials.

4. Bridge status information — INFORMATIONAL ONLY, AS-IS DISCLAIMER

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS.

Bridge status information displayed on IsBridgeUp comes from public agency feeds, third-party data, and voluntary user reports, and may be inaccurate, delayed, incomplete, or unavailable. A bridge may be raised while the Service shows it as lowered, and the reverse. We provide this information on an "AS-IS" and "AS-AVAILABLE" basis with NO WARRANTIES OF ANY KIND, express or implied, including but not limited to warranties of accuracy, reliability, timeliness, or fitness for a particular purpose.

THE SERVICE IS FOR GENERAL INFORMATION ONLY. IT IS NOT A NAVIGATION, TRAFFIC-CONTROL, OR SAFETY SYSTEM. YOU MUST NOT RELY ON ISBRIDGEUP FOR NAVIGATION, TRAFFIC, DRIVING, OR SAFETY DECISIONS. Always rely on what you see and on official traffic control. Bridge conditions can change at any moment without notice in the Service.

We do not operate, control, or monitor any bridge, and we do not control when bridges open or close.

4.1 Predictions, heatmaps, and Pro features

The Service may provide predictive features, including but not limited to timeline heatmaps, vessel tracking, raise forecasts, and estimated bridge opening/closing times or durations (collectively, "Predictions"). These Predictions are generated algorithmically based on limited historical data and pattern analysis. They are for informational purposes only and are not guaranteed to be accurate, complete, or timely.

Predictions do not constitute professional advice, official bridge schedules, or guaranteed forecasts. Actual bridge status may differ significantly from any Prediction. You must not rely on Predictions for driving, navigation, or any time-sensitive decisions.

We make no representations about the accuracy or reliability of Predictions and accept no liability for any loss, damage, delay, or inconvenience resulting from reliance on Predictions.

4.2 Third-party data sources

Some status information comes from third parties, such as public transportation agency feeds and alerts (for example, FL511 and the Seattle Department of Transportation) and vessel-tracking (AIS) data providers. We do not control these sources, and we do not guarantee that they are accurate, complete, timely, or continuously available. Third-party data may be delayed, missing, or wrong, and we are not responsible for errors in it.

4.3 Opening rules and schedules

Any bridge opening rules, restricted periods, or schedules shown in the Service are simplified summaries provided for convenience. They may be outdated or incomplete, and bridges may open outside of them (for example, for emergency or government vessels or when rules change). The official rules and the decisions of bridge operators and authorities always control.

4.4 Notifications

Push notifications and alerts are provided as a convenience. We do not guarantee that any notification will be sent, delivered, or delivered on time. Delivery depends on your device, its settings, your network, and third-party services (such as Apple, Google, and browser push services) that we do not control. Do not rely on notifications for time-sensitive or safety decisions.

4.5 Road safety

Do not use the Service while driving. Check the Service only when it is safe and legal to do so — for example, before you start driving, while safely parked, or by a passenger. You must always obey traffic signals, bridge gates and barriers, signs, bridge operators, and law enforcement, whatever the Service shows. You are solely responsible for how you drive and for complying with all traffic laws.

4.6 Your travel plans

You are solely responsible for planning your travel and allowing enough time for bridge openings, traffic, and other delays. To the maximum extent permitted by law, we are not responsible for any delay or its consequences — including missed appointments, meetings, flights, or other transportation; late fees, fines, or tolls; lost wages, business, or opportunities; or extra fuel, parking, or travel costs — even if you relied on information, Predictions, or notifications from the Service.

5. User-generated content

All bridge status reports, stream links, auction bids, and other content you submit are "User Content." You are solely responsible for your User Content.

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content in connection with the Service.

We do not verify or endorse User Content, and we have no obligation to pre-screen it. User status reports may be mistaken, outdated, or deliberately false. We are not responsible for any User Content submitted by users, including inaccurate bridge status reports, inappropriate stream content, or misleading information.

There is zero tolerance for objectionable content or abusive users. You can report content and block users in the Service, as described in our Community Guidelines. We may review, hide, or remove any User Content, and suspend or ban any user, at our sole discretion, without notice, for any reason. Our moderation does not mean that we verify bridge status reports or that all objectionable content will be caught.

5.1 Live stream content

Users may submit links to third-party live streaming platforms (TikTok, Instagram, YouTube, Facebook) through the Service's stream slot feature. We do not host, control, or endorse any live stream content. All live streams are hosted entirely on third-party platforms and are subject to those platforms' terms of service and content policies.

You are solely responsible for any content you stream or link to through the Service. By submitting a stream link, you represent that your content complies with all applicable laws and platform policies. We are not liable for any content, claims, damages, or disputes arising from user-submitted live streams, including but not limited to:

Illegal, harmful, defamatory, obscene, or inappropriate content.
Copyright or intellectual property infringement.
Privacy violations or unauthorized recording of individuals.
Any third-party claims related to stream content.

We reserve the right to remove any stream link at any time, without notice or refund, for any reason including suspected violation of these Terms or applicable law.

6. Points system

Points are a virtual, non-monetary reward within the Service. Points:

Have no cash value and cannot be exchanged for money.
Are non-transferable between users.
Are non-refundable once earned or purchased.
May be revoked by us at any time for abuse, fraud, or violation of these Terms.
May be modified in value or availability at our discretion with reasonable notice.

Points can be earned by reporting bridge status, confirming reports, and referring new users. Points can be spent on features such as live stream link placements, auction bids, and Pro day passes.

We reserve the right to adjust point earning rates, spending costs, and the overall points economy at any time.

7. Purchases and payments

Purchases made on our website (Pro subscriptions and point packs) are processed by Stripe and are charged in US Dollars (USD). Point purchases are final and non-refundable, except where required by applicable law or in cases of technical failure where points were not credited.

Pro subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price until you cancel. You can cancel at any time from your profile (Manage subscription); cancellation takes effect at the end of the current billing period, and you keep Pro access until then. Except where required by law, we do not provide refunds or credits for partial billing periods. Any free trial offered at sign-up does not require a payment method and does not convert into a paid subscription.

Prices, including launch or promotional prices, may change. If the price of your existing subscription changes, we will notify you in advance, and the new price will apply from your next renewal.

If you make a purchase through the Apple App Store or Google Play, billing, renewal, cancellation, and refunds are handled by that store under its terms.

You agree that KarasSoft LLC is the merchant of record for all purchases made through our website.

8. Stream auction marketplace

The stream auction allows users to spend points for the right to display a live stream link on a bridge status page while the bridge is up. Rules:

You can go live directly for the fixed number of points shown in the Service, if the slot is available.
Placing a bid starts a timed auction. When the timer ends, the highest bid wins automatically and the winner's points are deducted. Bids are binding unless cancelled before the auction ends.
A direct (non-auction) stream may be replaced by an auction winner; in that case, the replaced user's points are refunded.
When the bridge goes down, the stream ends and any unresolved bids expire without charge.
Stream link duration depends on how long the bridge remains up. There is no minimum guarantee of stream duration. This risk is borne entirely by the user.
Stream links must point to TikTok, Instagram, YouTube, or Facebook live content. Links to other platforms or non-live content may be removed without refund.

9. Advertising and third-party services

The Service may display advertising from local businesses. These advertisements are managed by us, are not targeted based on your personal data, and do not involve sharing your personal data with advertisers. We do not endorse advertisers and do not verify their claims, offers, or promo codes. Offers may change or be withdrawn by the advertiser at any time. Any dealings with an advertiser are solely between you and that advertiser, and we are not responsible for their products, services, or offers. You can report an ad to safety@isbridgeup.com.

The Service links to and relies on third-party websites and services (for example, streaming platforms, sign-in providers, payment processors, and parking or navigation services). Those third parties are governed by their own terms and privacy policies, and we are not responsible for their content, availability, or practices.

10. Prohibited conduct

You agree not to:

Submit knowingly false bridge status reports.
Post objectionable content or harass, threaten, or abuse other users, as described in our Community Guidelines.
Use the Service in a way that distracts you while driving or violates traffic laws.
Create multiple accounts or use automated tools to manipulate the Service.
Abuse the referral system by creating fake accounts.
Submit stream links containing illegal, harmful, obscene, defamatory, or inappropriate content, including content that violates third-party intellectual property rights or privacy.
Attempt to exploit the points system, auction, or any other feature through fraud or manipulation.
Interfere with the Service's operation or other users' access.
Scrape, crawl, or collect data from the Service without permission.
Use the Service for any illegal purpose.

Violation of these rules may result in immediate account termination, point forfeiture, and potential legal action.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL INFORMATION, PREDICTIONS, NOTIFICATIONS, AND CONTENT IN IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR TIMELINESS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME, OR THAT ANY INFORMATION IN IT IS CORRECT OR CURRENT. YOU USE THE SERVICE AT YOUR OWN RISK.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARASSOFT LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, WAGES, BUSINESS, OPPORTUNITY, TIME, OR DATA, OR FOR ANY COSTS OF DELAY (INCLUDING MISSED APPOINTMENTS OR FLIGHTS, LATE FEES, FINES, OR TOLLS), WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING FROM OR RELATED TO:

Your use of or inability to use the Service.
Any inaccuracy, delay, or unavailability of bridge status information, third-party data, Predictions, or opening rules.
Any notification that is not sent, delayed, or not received.
Any decisions you make based on information provided by the Service.
Any User Content, including false or misleading status reports.
Loss of points, stream time, or auction bids.
Unauthorized access to your account.
Any third-party content, products, services, or advertisements.
Any interruption or cessation of the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS (US $50).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In such cases, our liability shall be limited to the fullest extent permitted by applicable law, and nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless KarasSoft LLC, its members, managers, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from:

Your use of the Service.
Your User Content.
Your violation of these Terms.
Your violation of any law, including traffic laws.
Your violation of any third-party rights.

14. Intellectual property

The Service, including its design, code, logos, and content (excluding User Content), is owned by KarasSoft LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

"IsBridgeUp" is a trademark of KarasSoft LLC.

15. Termination

We may suspend or terminate your account at any time, for any reason, without notice. Upon termination:

Your right to use the Service ceases immediately.
Your points balance is forfeited and non-refundable.
We may delete your account data in accordance with our Privacy Policy.

You may delete your account at any time through the profile settings (Profile → Delete account). Sections 4, 5, 6, 9, and 11 through 21 survive any termination or account deletion.

16. Modifications to Terms

We may modify these Terms at any time. If we make material changes, we will notify you through the Service or via email. Your continued use of the Service after notification constitutes acceptance of the modified Terms.

If you do not agree with modified Terms, you must stop using the Service and delete your account.

17. Mobile apps and app stores

If you download our mobile app from the Apple App Store or Google Play, these Terms apply in addition to that store's terms. If you use our iOS app:

These Terms are between you and KarasSoft LLC only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
Apple has no obligation to provide any maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
Apple is not responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
If a third party claims that the app or your use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms (such as your wireless data service agreement) when using the app.
Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple has the right to enforce these Terms against you as a third-party beneficiary.

18. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

Informal resolution first. Before starting any arbitration or court proceeding, you agree to contact us at legal@isbridgeup.com with a description of your claim and the relief you want, and to give us 30 days to try to resolve it informally.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in Miami-Dade County, Florida. You agree to waive any right to a jury trial or class action.

For claims under $10,000, arbitration shall be conducted online or by phone at your election. We will pay all arbitration fees for claims under $10,000 unless the arbitrator determines the claim is frivolous.

To the extent any dispute is not subject to arbitration, it shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

19. Severability and general terms

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any failure or delay caused by events beyond our reasonable control.

20. Entire agreement

These Terms, together with the Privacy Policy, Cookie Policy, and Community Guidelines, constitute the entire agreement between you and KarasSoft LLC regarding the Service.
