These Terms of Service ("Terms") govern your use of IsBridgeUp, operated by KarasSoft LLC, a Florida limited liability company ("we," "us," or "our"). The Service includes our website at isbridgeup.com and web application at app.isbridgeup.com.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

IsBridgeUp is a community-driven platform that displays real-time drawbridge status information reported by users. The Service includes bridge status reporting, a points-based reward system, a live stream auction marketplace, and local business advertising.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement. If you are under 18, you must have parental or guardian consent.

3. Account registration

To report bridge status, earn points, or participate in auctions, you must create an account using Google or Facebook sign-in. You are responsible for maintaining the security of your account. You agree to provide accurate information and to update it as needed.

You may not create multiple accounts, impersonate other users, or share your account credentials.

4. Bridge status information — AS-IS DISCLAIMER

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS.

Bridge status information displayed on IsBridgeUp is community-sourced and may be inaccurate, delayed, incomplete, or unavailable. We provide this information on an "AS-IS" and "AS-AVAILABLE" basis with NO WARRANTIES OF ANY KIND, express or implied, including but not limited to warranties of accuracy, reliability, timeliness, or fitness for a particular purpose.

YOU MUST NOT RELY SOLELY ON ISBRIDGEUP FOR NAVIGATION, TRAFFIC, OR DRIVING DECISIONS. Always verify bridge status visually before proceeding. Bridge conditions can change at any moment without notice in the Service.

We do not operate, control, or monitor any bridge. We do not have access to official bridge operation systems. All status information comes from voluntary user reports which may be incorrect.

4.1 Predictions, heatmaps, and Pro features

The Service may provide predictive features, including but not limited to timeline heatmaps, vessel tracking, and estimated bridge opening/closing times (collectively, "Predictions"). These Predictions are generated algorithmically based on limited historical data and pattern analysis. They are for informational purposes only and are not guaranteed to be accurate, complete, or timely.

Predictions do not constitute professional advice, official bridge schedules, or guaranteed forecasts. Actual bridge status may differ significantly from any Prediction. You must not rely on Predictions for driving, navigation, or any time-sensitive decisions.

We make no representations about the accuracy or reliability of Predictions and accept no liability for any loss, damage, delay, or inconvenience resulting from reliance on Predictions.

5. User-generated content

All bridge status reports, stream links, auction bids, and other content you submit are "User Content." You are solely responsible for your User Content.

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content in connection with the Service.

We do not verify, endorse, or moderate User Content. We are not responsible for any User Content submitted by users, including inaccurate bridge status reports, inappropriate stream content, or misleading information.

We reserve the right to remove any User Content at our sole discretion, without notice, for any reason.

5.1 Live stream content

Users may submit links to third-party live streaming platforms (TikTok, Instagram, YouTube, Facebook) through the Service's stream slot feature. We do not host, control, moderate, or endorse any live stream content. All live streams are hosted entirely on third-party platforms and are subject to those platforms' terms of service and content policies.

You are solely responsible for any content you stream or link to through the Service. By submitting a stream link, you represent that your content complies with all applicable laws and platform policies. We are not liable for any content, claims, damages, or disputes arising from user-submitted live streams, including but not limited to:

Illegal, harmful, defamatory, obscene, or inappropriate content.
Copyright or intellectual property infringement.
Privacy violations or unauthorized recording of individuals.
Any third-party claims related to stream content.

We reserve the right to remove any stream link at any time, without notice or refund, for any reason including suspected violation of these Terms or applicable law.

6. Points system

Points are a virtual, non-monetary reward within the Service. Points:

Have no cash value and cannot be exchanged for money.
Are non-transferable between users.
Are non-refundable once earned or purchased.
May be revoked by us at any time for abuse, fraud, or violation of these Terms.
May be modified in value or availability at our discretion with reasonable notice.

Points can be earned by reporting bridge status, confirming reports, and referring new users. Points can be spent on live stream link placements and auction bids.

We reserve the right to adjust point earning rates, spending costs, and the overall points economy at any time.

7. Purchases and payments

Point purchases are processed by Stripe and are charged in US Dollars (USD). All purchases are final and non-refundable, except where required by applicable law or in cases of technical failure where points were not credited.

Promotional pricing is temporary and may change at any time without notice. The regular price displayed alongside promotional pricing represents the intended future price and is not a guaranteed price.

You agree that KarasSoft LLC is the merchant of record for all purchases made through the Service.

8. Stream auction marketplace

The stream auction allows users to bid points for the right to display a live stream link on the bridge status page. Auction rules:

Bids are binding. Points are charged upon acceptance (manual or auto-accept after timer).
The reporter may accept any bid at their discretion, not necessarily the highest.
If the bridge status changes to DOWN, all pending bids are cancelled without charge.
Stream link duration depends on how long the bridge remains up. There is no minimum guarantee of stream duration. This risk is borne entirely by the bidder.
Stream links must point to TikTok, Instagram, YouTube, or Facebook live content. Links to other platforms or non-live content may be removed without refund.

9. Advertising

The Service may display advertising from local businesses. These advertisements are managed by us and do not involve sharing your personal data with advertisers. We are not responsible for the products, services, or offers of third-party advertisers. Clicking on an ad may take you to a third-party website governed by its own terms and privacy policy.

10. Prohibited conduct

You agree not to:

Submit knowingly false bridge status reports.
Create multiple accounts or use automated tools to manipulate the Service.
Abuse the referral system by creating fake accounts.
Submit stream links containing illegal, harmful, obscene, defamatory, or inappropriate content, including content that violates third-party intellectual property rights or privacy.
Attempt to exploit the points system, auction, or any other feature through fraud or manipulation.
Interfere with the Service's operation or other users' access.
Scrape, crawl, or collect data from the Service without permission.
Use the Service for any illegal purpose.

Violation of these rules may result in immediate account termination, point forfeiture, and potential legal action.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARASSOFT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

Your use of or inability to use the Service.
Any inaccuracy in bridge status information.
Any decisions you make based on information provided by the Service.
Loss of points, stream time, or auction bids.
Unauthorized access to your account.
Any third-party content, products, or services.
Any interruption or cessation of the Service.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability shall be limited to the fullest extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless KarasSoft LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from:

Your use of the Service.
Your User Content.
Your violation of these Terms.
Your violation of any third-party rights.

13. Intellectual property

The Service, including its design, code, logos, and content (excluding User Content), is owned by KarasSoft LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

"IsBridgeUp" is a trademark of KarasSoft LLC.

14. Termination

We may suspend or terminate your account at any time, for any reason, without notice. Upon termination:

Your right to use the Service ceases immediately.
Your points balance is forfeited and non-refundable.
We may delete your account data in accordance with our Privacy Policy.

You may delete your account at any time through the profile settings.

15. Modifications to Terms

We may modify these Terms at any time. If we make material changes, we will notify you through the Service or via email. Your continued use of the Service after notification constitutes acceptance of the modified Terms.

If you do not agree with modified Terms, you must stop using the Service and delete your account.

16. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in Miami-Dade County, Florida. You agree to waive any right to a jury trial or class action.

For claims under $10,000, arbitration shall be conducted online or by phone at your election. We will pay all arbitration fees for claims under $10,000 unless the arbitrator determines the claim is frivolous.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and KarasSoft LLC regarding the Service.
